Part B: E-Commerce Terms of Sale

These Terms of Sale apply to all purchases of physical products made through our Website. By placing an order, you agree to these Terms.

1. Orders

All orders are subject to availability and confirmation of payment. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Refunds & Returns Policy.

We reserve the right to refuse or cancel an order, limit quantities, correct pricing errors, and cancel orders where fraud is suspected. If an order is cancelled after payment has been processed, a full refund will be issued.

We have made every effort to display as accurately as possible the colours and images of our products that appear in the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate. We reserve the right to discontinue any product at any time.

2. Pricing & Payment

All prices are listed in Australian Dollars (AUD) and include GST where applicable. Payment must be made in full at the time of purchase. We accept payment methods listed at checkout. We reserve the right to change prices at any time prior to purchase.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store, and to promptly update your account and other information so that we can complete your transactions and contact you as needed.

3. Shipping & Delivery

We ship within Australia unless otherwise specified. Shipping costs are calculated at checkout. Delivery timeframes provided are estimates only and may vary due to courier delays, regional locations, weather events, or high-demand periods. We are not liable for delays outside our reasonable control.

Risk in the goods passes to you upon delivery to the nominated address. You are responsible for providing accurate delivery details. Additional costs arising from incorrect information may be charged to you.

4. Inspection Upon Delivery

You must inspect goods upon delivery. If goods are damaged, faulty, or incorrect, notify us within 14 days and provide photographs where possible. Failure to notify us within a reasonable timeframe may affect your claim.

5. Returns & Refunds

Returns and refunds are governed by our Refunds & Returns Policy. Nothing in these Terms excludes your rights under the Australian Consumer Law.

6. Custom and Made-to-Order Products

Custom and made-to-order products may require a deposit prior to production. Deposits are non-refundable once production has commenced. Production timeframes are estimates only. Due to the handmade nature of concrete, variations in colour, texture and finish, and natural air pockets, are not considered defects. Final payment may be required prior to dispatch or installation (if applicable).

7. Large or Heavy Items

Some items (including sinks, vanities, bathtubs, and architectural pieces) may require freight shipping, may incur additional handling costs, and may require forklift or specialised unloading at the delivery location. You are responsible for ensuring appropriate access and unloading facilities. Additional costs arising from failed delivery attempts may be charged to you.

8. Title to Goods

Ownership of goods passes to you only once full payment has been received.

9. Limitation of Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of business, income, or profit. Our liability is limited to the amount paid for the goods. Nothing in these Terms excludes rights under the Australian Consumer Law.

10. Force Majeure

We are not liable for delays or failure to perform obligations due to events beyond our reasonable control, including natural disasters, supply chain disruptions, transport failures, and government restrictions.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the jurisdiction of Queensland courts.
